SCHUFA notice for rental applications

In order to conduct a credit check on the prospective tenant prior to conclusion of the rental contract, Volkswagen Immobilien GmbH transfers personal data collected within the scope of this contractual relationship concerning the application for this rental agreement, as well as data concerning non-contractual or fraudulent conduct, to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden.

The legal basis for this transfer is Article 6(1)(b) and Article 6(1)(f) of the General Data Protection Regulation (GDPR). Transfers based on Article 6(1)(f) GDPR may only occur if these are required to safeguard the legitimate interests of Volkswagen Immobilien GmbH or third parties, and the interests or basic rights and freedoms of the affected party demanding protection of the personal data do not prevail.

SCHUFA processes data and also uses them for the purposes of profiling (scoring) in order to provide its contractual partners in the European Economic Area and Switzerland, as well as additional third countries (if an adequacy decision has been made by the European Commission), with information concerning, for example, the evaluation of a natural person’s creditworthiness. I consent to Volkswagen Immobilien GmbH transferring data concerning the application for this rental contract to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden, and receiving information from SCHUFA about me.

Irrespective of this, Volkswagen Immobilien will also transfer data to SCHUFA concerning non-contractual conduct (e.g. outstanding amounts following enforcement after termination as per Section 543 paragraph 2 item 3, Section 569 paragraph 3 BGB and/or due to default of payment as per Section 573 paragraph 2 item 1 BGB). The Federal Data Protection Act states that these reports may only occur if this is admissible after balancing the interests of all parties involved.

SCHUFA stores and transfers data to its contractual partners within the EU domestic market in order to provide this information for the evaluation of the creditworthiness of natural persons. SCHUFA’s contractual partners are primarily credit institutions and credit card and leasing companies. In addition, SCHUFA also issues information to retail, telecommunications and other companies that offer services and deliveries on credit. SCHUFA only provides personal data if a legitimate interest has been credibly presented for doing so on a case-by-case basis. SCHUFA discloses address data to determine debtors. When communicating information, SCHUFA may additionally disclose to its contractual partners a probability value calculated from its database to evaluate the credit risk (score procedure).
